What I stand for

A single-party report is not enough, on its own, to found a decision (Cour de cassation, Mixed Chamber, 28 September 2012, appeal no. 11-18.710). I build every report so that it can be corroborated, jointly where possible, and read at the hearing.Erwan BARGAIN, Property valuation expert registered with the RENNES Court of Appeal

Frequently asked questions

What are your lead times?
As a guide: desktop opinion, a few days; full valuation or critical review of an opposing report, about three weeks; eviction, businesses and shares, about four weeks after receipt of the documents. The lead time is written into the engagement contract and procedural emergencies are discussed case by case.
What does the report look like?
Engagement letter, presentation of the parties and the purpose, documents examined, description, market, methods, calculations, value, reservations, appendices. Every comparable is identified. The report is paginated and signed; a PDF and a paper version are supplied.
Are you available for the hearing or a joint meeting?
Yes. Attendance at the meeting is included in joint private valuation engagements. An additional hearing or meeting is charged by time spent, €65 per hour, VAT not applicable.
Do you accept fees based on results?
No. The Charte de l'expertise en évaluation immobilière forbids it: "under no circumstances may the fee be linked to the value of the property valued, in order to guarantee the neutrality and impartiality of the valuation" (Title I, §2.1, translated from the French). In court matters, the expert may not receive any direct payment from a party (article 248 of the Code of Civil Procedure).
Do you work with specialist colleagues?
Yes: a building surveyor for the technical findings, a land surveyor for floor areas and boundaries, a chartered accountant for operating companies. I coordinate their work and integrate their conclusions into the valuation report.
